Three months later, a US Court of Appeals decision stopped the injunction issued by the federal court judge pending an appeal. The main legal point of appeal is the right of the FDA to regulate electronic cigarettes based on their ability to regulate nicotine therapies such as gum or patches. A second argument propounded by the agency is that the latest tobacco laws expressly excludes any item or device from the definition of tobacco products when the item is a drug, device or any product falling under the Food Drug and Cosmetics Act. Later that year, the appellate court voted unanimously against the FDA’s right to regulate the E cig as a tobacco related product and has no power to block the importation of the same into the country. The ruling further stated that the E cig can only fall within the purview of the FDCA if the product was marketed for therapeutic purposes.
